By using or browsing our platform and by applying for membership and availing of Swapoffi membership, you agree to all of these terms and conditions.
These Terms shall be governed by and construed in accordance with the laws of Ireland, irrespective of the nationality of the Member or location of homes and swaps.
2. Our Website
Use of this website is provided by Tarotto Ltd ("Us") to you, ("You") and any service contained within constitutes acceptance of these Terms & Conditions.
3. Membership Use
3.1 Our website is only intended for use by adults, as defined as those aged 18 or over and who have sufficient capacity to enter into a binding agreement, and who have the legal ownership and / or rental and lease authority to swap their home with other verified Swapoffi members.
3.2 By joining Swapoffi, you consent to share your approved public profile details of your location, and an accurate description of your home and home office, on our website. This allows both verified members and public browsers to view Swapoffi home and home offices, with the objective of growing our membership base.
3.3 Full details of your home and your home office will only be shared with verified Swapoffi members, with whom you confirm swap arrangement, via the Swapoffi online platform.
3.4 Members earn ‘Swappie’ credits each time they host a verified member in their home. Swappies accumulate and can be used in any members’ home, depending on calendar availability. Swapoffi records and maintains information on your Swappies, which is available for you to view anytime, in your Swapoffi account.
3.5 Membership is not transferable. Swappies are not transferable.
4. Account Integrity
4.1 As part of the registration process you will need to create an account, including a username & password. It is your responsibility to ensure that the information you provide is accurate and not misleading. You cannot create an account or username & password using the names and information of another person or using words that are the trademarks or the property of another party or vulgar, obscene or in any other way inappropriate.
4.2 To complete your membership, you must profile your home and home office on www.swapoffi.com, as well as your personal profile. Your Swapoffi membership is not complete until all of this information has been uploaded. Only when this information is uploaded and subsequently verified by Swapoffi, is your membership active.
4.3 You are responsible for maintaining your own username and password via our website. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party.
4.4 You are responsible for your customer account and any information and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.
5. Membership Use
5.1 We make every effort to ensure that the membership fees displayed on our website are correct. However, if an error in the pricing is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable).
5.2 We reserve the right to alter all pricing without notice. Changes in prices will not affect current members in their current year of membership.
5.3 No cash or other form of remuneration should ever be exchanged by Swapoffi members.
5.4 Swappie credits have no cash value and should never be exchanged or sold.
5.5 Upon cancellation of your Swapoffi membership, your Swappie credit cease to exist.
6. Your Membership
6.1 When you join Swapoffi, you will automatically receive a confirmation email from us. Your membership application constitutes an offer made to us to purchase a membership (or for a free trial or promotional membership).
6.2 Your application is only accepted by us once we have emailed you to confirm the creation of your account and your username & password details and the product or service has been provided to you.
6.3 Service items not included within your account email are not included in the order and contract between you and us.
6.4 We reserve the right to delay or refuse orders where a membership application contains incomplete details or details that cannot be verified or where fraud is suspected.
6.5 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered, nor will a refund be made to any third-party card or account.
7. Subscription Period & Free Trials
7.1 From time to time, we may offer free trials or discounted membership or other promotional offers. These will only apply to new members.
8. Cancellation Rights and Refunds
8.1 If you are a fully paid up and verified Swapoffi member, and you do not swap your house OR swap with other verified Swapoffi members in the first 12 months of your membership, Swapoffi may offer you a second year of membership free of charge.
8.2 If you choose to cancel your membership, at any time for any reason, you are not entitled to a refund.
8.3 If you choose to cancel your membership, please inform us by emailing [email protected] with "Cancel my profile" in the subject line.
9. Content Submission
9.1 In order to provide our home exchange service, we require those interested in joining Swapoffi to provide us with certain information about (a) your home e.g., number of bedrooms, accessibility, rural vs urban, transport links, etc. (b) your home office e.g., a dedicated space in your home or within another room with another defined purpose; facilities e.g., printer, monitor size etc. and (c) your Wi-Fi robustness.
This information allows other verified members to identify suitable locations and homes to swap in.
Full details, including your home address or your direct contact details, will never be provided in your public profile.
9.2 Swapoffi operates a 4-step verification process for members’ peace of mind.
Swapoffi will verify the information you have provided to the best of our ability, in order to ensure other verified members swap in good faith, based on the information you have provided, and you have verified.
Without this information, we cannot offer homes and home offices for members for swapping.
9.3 Please submit all information required by Swapoffi to profile your location, home and home office. Without the required information, your profile may not be verified. This information includes written profiles and descriptions, as well as images and videos. You will be guided through this process as part of your application.
9.4 Swapoffi accepts no responsibility for inaccurate or missing information provided by members.
9.5 Swapoffi reserves the right to remove or delete any information which is offensive in nature to our community or the browsing public; or any information which we do not believe to be authentic about an advertised property.
10. Updating your Profile
10.1 Members are required to maintain up to date profiles. If there are any changes to your home or home office, please update your profile for accuracy. Other members rely on your description when browsing and choosing swaps. This is particularly important when describing numbers of bedrooms, access, room sizes, and home office features, as well as home location and features e.g., quiet, or noisy environment.
10.2 Any change of ownership in your home should be updated and in the event of a sale, your profile should be removed. Swapoffi has no responsibility for home ownership issues.
11. Content Ownership
11.1 Swapoffi retains the right to the information you have submitted about your location, home and home office, worldwide and royalty free. This includes images, written descriptions and profiles and videos.
11.2 Swapoffi will never share your personal information without your permission.
11.3 This information will only be used for the purposes of operating Swapoffi.
11.4 If a member leaves Swapoffi or requests their profile to be deleted, we will be happy to do so as soon as any active swaps on that property are complete. Members can use the calendar to stop bookings.
11.5 Swapoffi reserves the right to de-list a property or profile or to cancel a membership for any reason. In this event, we will refund the relevant portion of a membership, to the credit card from which payment was originally made, and only to the person profiled in the membership application.
12.1 Communications between members should only take place on the Swapoffi platform.
12.2 Communications should be around the Swapoffi service of location interest, home and home office swapping and / or earning or spending Swappie credits.
12.3 Communications that are abusive, inappropriate, illegal, or otherwise inappropriate will be deleted and that member’s profile will be de-listed without recourse. Any membership fees paid by a member in this instance will not be refunded as they will be required for administration and record keeping.
13. Home Swaps
13.1 Swapoffi accepts no responsibility or liability for home swaps between members.
13.2 Swapoffi accepts no responsibility or liability for any agreements or arrangements between members.
13.3 Swapoffi accepts no responsibility or liability arising from any damages in members’ homes as a result of a home swap.
We strongly recommend that each member advises their home insurance and travel insurance provider of any swaps and alter them accordingly if required.
Our service is to introduce and facilitate swaps through our website only. Home swaps are entirely arranged between members, and not through Swapoffi.
13.4 Swapoffi does not own or rent any homes or contents of any homes. Swapoffi has not provided the profile information for each home, visual or written. Therefore, Swapoffi cannot take any responsibility for any home or be liable for any costs or damages from swapping. Your host is your point of contact in the event of any issues during a swap. We also advise members to check with their home insurance and travel insurance providers before each swap, in the event you can or need to update any such policies.
14. Customer Complaints
Please send any complaints to [email protected] and enter “Complaint” in the subject box. We will review and respond within 30 days at the very latest.
15. Events outside our control
Swapoffi is not liable for any costs or damages outside our control, including and not limited to travel to and from a swap.
16. Entire Terms & Conditions
These terms and conditions may be updated at any time by Swapoffi. This will be reflected by the update date on this website.
